For over 25+ years, we have been assisting clients with real estate related matters. As a result, we have worked on most types of real estate transactions. Solving real estate related issues is often like figuring out how to solve Rubik’s cube. The reality is that it takes years of practical experience to effectively analyze the situation, do the necessary research, review the various options and then implement decisions made by the client(s) in order to complete the problem solving process.

1. Tax issues relating to acquiring, holding and/or disposing of real estate. 2. Asset protection options for real estate owners. 3. Preparation of purchase contracts for residential, commercial or industrial real estate. 4. Mediation of real estate related disputes. We are also able to assist with IRS Estate and Gift tax planning for both U.S. citizens and foreigners (including green card holders) with real property here in the United States. In addition, we can help non-citizens who are considering buying or leasing real property in the United States. Non-resident aliens can find themselves in a great deal of trouble without effective prior planning.

We focus on assisting high net worth individuals with services ranging from: asset protection planning, co-tenancy agreements, For Sale By Owner (FSBOs) sales, 1031 exchanges, family business entity planning, offshore jurisdiction selections, life insurance trusts, irrevocable trusts, non-citizen spouse estate and gift tax planning, California resident issues (a person is considered to be a resident and taxable in California if they are here for other than a “temporary or transitory” purpose, charitable remainder trusts (CRT), charitable lead annuity trusts (CLAT), mediation of business “divorces” gone bad, partnership disputes, family business succession planning, and other transfer planning intermediary services.
Mr. McDermott is a member of several international organizations. The first is the Society of Trust and Estates Practitioners (“STEP”). That organization has experts in complicated estate planning issues in most countries of the world. Access to this group of professionals allows us to reach out to most foreign jurisdictions and quickly find someone who can provide answers to difficult questions.
In addition, Mr. McDermott is a member of the National Association of Realtors’ international group of real estate professionals (Certified International Property Specialists (“CIPS”)) with members in most countries of the world. Again, this allows us to reach out and find a qualified real estate professional to assist our clients with their real estate needs. There are also many CIPS in the United States so we can help find agents in most U.S. cities.
Finally, as President of Mainsail Financial Group, Inc. (“Mainsail”), a California corporation, Mr. McDermott is able to work directly as a real estate broker for either buyers or sellers. When Mainsail represents someone as their buyer’s agent, Mainsail will rebate 50% of its real estate commissions at the close of escrow. In a recent transaction the buyer was entitled to receive $85,000.
