As lead counsel in three week jury trial, obtained $9.2 million judgment for breach of contract and breach of fiduciary duty, including over $1 million in punitive damages, on behalf of a partner in a real estate joint venture against her co-venturer.
Multiple representations of Olympic Gold and World Champion boxer Oscar De La Hoya and his related entities in prosecution and defense of claims in State and Federal Courts and before state regulatory body; matters have included a dispute with a promoter in which summary judgment was obtained voiding a long term contract; a dispute with a former business manager in which a very favorable settlement was obtained; and defense of a claim of theft of intellectual property in connection with a reality television program which was favorably settled.
Represented artist Thomas Kinkade and his company in a successful defense of a three week arbitration involving multi million dollar breach of contract and business tort claims.
Obtained preliminary injunction on behalf of insurance broker/employer against long term employees and their new employer to prevent unfair competition or use of former employer’s trade secrets; case was resolved on a favorable basis for employer, including provisions to prevent future unfair competition.
Successfully defended the former COO of a motion picture production and distribution company in defense of multi-million dollar claims of alter ego, fraud, conversion, and breach of contract; the case was dismissed in response to our Motion for Summary Judgment.
Represented two professional photographers in a copyright infringement and breach of contract action against a large health care provider/insurer which had exceeded its license to use a library of photographs created by the photographers; the matter was settled favorably.
